Terms of service
Terms of service.
Social Mediator (Pty) Ltd · Last updated 29 October 2026
The short version.
- These terms cover our services, including connecting your business's WhatsApp account to our Meta app, Social Mediator Connect.
- Your WhatsApp account and number stay yours. You follow Meta's and WhatsApp's rules, you only message people who agreed to hear from you, and you pay Meta's message fees directly.
- Our liability is limited, and you cover claims caused by your messages. Please read sections 8 and 9.
- Anything specific we agree with you in writing, such as prices, comes first, except the WhatsApp rules in sections 2 and 3, which always apply.
1. Who we are and what these terms cover
Social Mediator (Pty) Ltd ("Social Mediator", "we", "us") is a private company registered in South Africa. Our company details are in section 12. These terms apply to the services we provide to businesses ("you"), including the WhatsApp connection made through our Meta app, Social Mediator Connect, on the AI Concierge (concierge-chat.com) and AIOS platforms. If you have a separate written agreement with us, that agreement wins where the two differ, except sections 2 and 3, which always apply.
You confirm that you are an adult and are authorised to act for your business.
2. Connecting your WhatsApp account
- You connect your own WhatsApp account through Meta's sign-up window. You keep ownership of your Meta business portfolio, your WhatsApp account and your phone number.
- By connecting, you let our app send and receive WhatsApp messages and manage message templates on that account, for the services you use with us.
- By connecting, you also agree to Meta's terms for the WhatsApp Business Platform and the WhatsApp Business Messaging Policy, as Meta requires.
- You can disconnect at any time. See our data deletion page for how.
3. Your responsibilities
- Follow the WhatsApp Business Messaging Policy and the law where you and your customers are.
- Only message people who have agreed to hear from your business, in a way that meets the law. Stop when they ask, whether they ask on WhatsApp or elsewhere. Every marketing message must say who it is from and how to opt out.
- If you use AI or automated replies, give customers a clear way to reach a person, such as a handover in the chat, a phone number or an email address.
- Do not use data you get through WhatsApp in any way Meta's terms forbid. For example, do not build profiles of people from it, do not sell or share it, and do not use it to train AI models.
- Do not ask for or send full card numbers, ID numbers, passport numbers or health information in WhatsApp messages.
- Do not use the service for anything unlawful, misleading or harmful, or to sell or promote things WhatsApp restricts or prohibits, such as firearms, alcohol, tobacco, gambling or adult products, unless WhatsApp allows it in that country.
- Keep your logins safe, and tell us straight away if you think someone else has used them.
- You are responsible for the content you send, for the information you give the AI, and for checking its settings.
4. Meta's fees and ours
Meta bills your business directly for WhatsApp messages, on the payment method you set up with Meta. Meta sets and can change those prices. Our own fees are as agreed with you in writing and do not include Meta's.
5. The service
- We work hard to keep the service running, but it depends on Meta and other providers, so we cannot promise it will always be available or free of errors. We are not responsible for events outside our reasonable control.
- Meta reviews every message template and can reject or pause it. Outside the 24-hour reply window that opens when a customer messages you, only approved templates can be sent. We cannot guarantee that Meta will approve a template.
- Meta can limit or suspend a WhatsApp account, for example for low quality or a policy breach. That is Meta's decision, not ours.
- Replies drafted or sent by AI can be wrong. Check anything important.
- We may change or improve the service. We tell you in advance if a change materially affects you.
6. Personal information
We handle personal information as described in our privacy policy. For your customers' messages, you are the responsible party and we are your operator under POPIA. This means:
- We only process your customers' information on your instructions, to provide the service.
- We keep it confidential and protect it with reasonable security measures.
- We tell you straight away if we think someone has accessed it without permission.
- We only use service providers who are bound to the same standards, and we tell you before we add a new one. The current list is in our privacy policy.
- We help you answer your customers' requests about their information.
- When the service ends, we delete the data, or return it to you if you ask, within 30 days.
If your business is in the UK, Bahrain or another country with its own data protection law, we will sign a data processing agreement with you if you need one.
7. Suspending or ending the service
You can stop at any time by disconnecting your WhatsApp account and telling us. We may suspend or end the service if you breach these terms or WhatsApp's policies, or if Meta requires it. We give you notice first where we reasonably can. If we end the service for any other reason, we give you 30 days' notice. When the service ends, we delete your data or return it to you, as described in section 6.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by Meta, WhatsApp or other third-party services. Our total liability to you is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Claims caused by your messages
If someone makes a claim against us because of messages you sent, or because you broke WhatsApp's rules or the law, you cover our reasonable costs.
10. Your content and our software
Your content stays yours. You let us use it only to run the service for you. Our software, including the AI assistant and the platform, stays ours.
11. Law, disputes, changes and contact
These terms are governed by the law of South Africa. We will first try to resolve any dispute by talking. If that fails, the South African courts decide.
We may update these terms. We email you at least 30 days before a change that affects you. If you do not agree, you can stop using the service. The date at the top shows when they last changed. Questions: luke@socialmediator.net.
